The Pentagon is asking Congress for more than $450 million for maintaining and upgrading the Guantanamo Bay prison that President Barack Obama wants to close.

As an outsider I could never understand the rationale for Guantanamo. Billions of dollars spent on three dubious convictions to date, and serious damage to the US image.
One way to look at it is that if you don't apply the rule of law to those accused of being your enemies, how can you expect them to treat any of your people that they capture any differently?
One of the three convictions was a dopey young Australian (David Hicks) who was sold to the CIA by an Afghan warlord. After five years in a cage he pleaded guilty to the offence of aiding and abetting terrorism (which wasn't even extant when he was accused of doing it, and is not kosher under international law anyway).

Just put them through the public justice system with the media barred from the trials. I bet most of the cases will be done within a year or two, then guantanamo can close, the guilty can be punished, the public can get at least some closure knowing they have been found guilty legally, and everyone (but the terrorists) wins.

Under the Laws of War, the detainees in Guantanamo are illegal combatants. As such, the deserve nothing more than a bullet in the back of the head.

I took a deep breath, told myself not to respond in order to avoid flaming or Duckk's wrath, but just can't let this stay.
Under International Law most there have been kidnapped illegally, and are being treated inhumanely. If it was being done by a weak obscure African dictatorship the world would be calling for sanctions and hauling the leaders up before the Hague. Because it's the US the rest of the world does not have the power to do this.
Regardless of any laws the comment about deserving nothing more than a bullet in the back of the head indicates the writer has sociopathic tendencies. For a start even under the deliberately weak defence system extant at Guantanamo very few people have been found guilty of anything, even the retrospective laws. It has been proven that many have simply been in the wrong place at the wrong time, doing nothing against anyone. So to say that they are illegal combatants without any proof or lawful process is plain wrong.
Regarding law and order I'm probably more hard line than most, but you do need to have the trial before the hanging.
Sorry Duckk if I've been too emphatic.

As a US citizen, I must agree with Daryl. That is the problem with any trial that takes place there. There is no proof of any of the charges being leveled. I still don't understand why it is still in operation. It should have been shut down years ago, if it there was any reason to start it up in the first place.

Hi all,

I agree with Daryl and Knick. Whenever the government does not follow the rules there are problems. Either they re capture enemy and thus held under terms of prisoners of war, or they are criminals deserving of a trial. The executive portion of the Government has made this atrocious perversion using torture to extract information in violation of our treaty obligations. This unjust and illegal situation situation makes it hard to say "We're the good guys," without the world laughing at our hypocrisy.

They think they're soldiers. I'd say put them on trial and if they're found guilty, that proves they're nothing but common criminals.

Its innocent until proven guilty, so we cant call them criminals or say they have done anything until its been proven alphapatch. and until a court case is convened for them all and they are all put through the justice system we dont know whos guilty and who isnt. and as daryl notes, even under the current treatment and disrespect for them, most still havent been proven guilty.
