Which is an upcomming case before SCOTUS.

Simple, Gamble was on parole from one state, and was caught in a second state with a gun. A violation of state and federal law.

Was tried, and convicted, by the state and given a lightish sentence, then tried and convicted by the feds and given a heavier sentence.

His appeal is on the double jeopardy of being tried twice for the same act.

The potential implications, if successful, are staggering.
Firstly, who gets precedence, state or federal?
How long does the sovreignity with preference have to file charges before the unpreferenced one can?
What about Statute limitations?
Pardons?
Plea deals?
Hell, state rights vs federal rights?
(Over my amatuer head) but does tort law come into this, re: wrongful damage suits etc.

Tax law, where the one act can violate different federal and state tax laws? (Failure to declare, or outright hiding an income for example)

A parole violation in one state. A federal gun conviction in the other.

Son, your mother says I have to hang you. Personally I don't think this is a capital offense. But if I don't hang you, she's gonna hang me and frankly, I'm not the one in trouble. —cthia's father. Incident in ? Axiom of Common Sense

No, literally possesing a gun while a felon in both cases.

My mistake above, he was on parole in Alabama and the traffic stop was in Alabama

It actually is an interesting case.

It is very similar to the enhanced sentencing of the Hammond family in Oregon for alleged arson. (Hammonds had started a backfire to protect their ranch from being burned out by a fire on BLM property that was not being suppressed) An agreement was reached during trial in which the Hammonds agreed to not appeal in return for a limited sentence.

An evil bitch US Attorney for Oregon appointed by Obama insisted on resentencing the Hammonds after trial on alleged "terrorism" charges. The primary purpose was to confiscate the Hammonds property. Amanda Marshall resigned after being charged with harrassing a subordinate, whom she was having a year long extramarrital affair with, then suspended by the Oregon Bar for committing perjury by denying it. She now practices as a criminal attorney specializing in the Oregon marijunna business, most of which is actually sold on the black market. It appears that Amanda gave her husband, Judge Ladd Wiles of Yamhill County, a dose of syphyllus that prnicillin can not cure which is now taking a toll on his brain. He recently gave a marijunna bootlegger a free pass forshooting two rounds (probably slugs) from a 12 gauge shotgun at his neighbor's children. The bootlegger's excuse was "we're old. We dont have time to shoot at children."

Why don't you tell us the whole story about that case, TFLY?

Oh right, it's because doing so wouldn't let you rant about a woman.

You cite Wikipedia which has been massaged by the BLM wildlife refuge groupies?

Ask yourself why a grand jury in Malhuer County refused to indict.

I call the prosecutor an evil bitch because she is an evil bitch, not because she is a woman.

They were tried in a federal court on federal charges and given a sentence that didn't meet the sentencing minimums. The feds appealed and the sentence was raised to meet the minimum.

In what way is that line up with Gamble?

Now, personally, I don't agree with minimum sentences, nor screwing around with plea deals unless there appears to be blatant bias or corruption. But neither if those have anything to do with the subject.
